1. Introduction

Welcome to XAPP, a unified communication platform operated by Riptec Ltd. XAPP helps individuals and teams centralize conversations across messaging platforms, enabling greater control, organization, and privacy. By registering an account or using the XAPP services, you agree to these Terms and Conditions ("Terms").

2. Account Types and Services

Free Version:
- Designed for individual users.
- Provides centralized messaging across supported platforms.
- Users may optionally add a Virtual Mobile Number for privacy or multi-account use, subject to additional cost.

Premium Version:
- Enables multi-user access, group-based collaboration, and advanced profile management.
- Suitable for businesses, teams, or users managing multiple brands or identities.

Premium+ Version:
- Tailored for teams needing structured workflows.
- Converts inbound WhatsApp messages into ticket-style conversations.
- Includes:
  - Queuing, routing, and timer-based assignment
  - Ticket lifecycle management (status, transfer, closure)
  - CRM integration, analytics, and media handoff tools.

3. Eligibility and Registration

To use XAPP:
- You must be at least 18 years old (or of legal age in your country)
- Agree to these Terms and our Privacy Policy
- Register with accurate and up-to-date information

You are responsible for safeguarding your credentials and all activity under your account.

4. User Conduct and Acceptable Use

You agree not to misuse XAPP, including but not limited to engaging in spam, harassment, illegal activity, impersonation, or attempts to reverse-engineer or overload the system. Not to impersonate others or misrepresent identity. You agree to comply with all applicable messaging regulations (e.g. WhatsApp terms, SMS rules).
Violations may result in suspension or termination of service without recourse.

5. Third-Party Platform Compliance

When using XAPP to access or integrate with third-party messaging platforms (e.g., WhatsApp, SMS gateways), you agree to comply with the terms of service, usage policies, and guidelines of those platforms. XAPP disclaims all responsibility for any actions taken by third-party services or consequences of violations of their terms.

6. Temporary Data Handling and Privacy

XAPP may temporarily retain user content (such as messages, attachments, metadata, and routing information) for the purpose of delivering and supporting service functionality across all user plans, including Free, Premium, and Premium+.

Examples of processing activities include:
- Message routing and centralized communication display
- Ticket creation and lifecycle management (Premium+)
- Group collaboration and multi-agent chat handling (Premium)
- Analytics, export, and usage reports
- Transfers to client-defined destinations (e.g., CRM, cloud storage)

Upon conversation closure or expiry as configured by the user or administrator, all retained data (including threads and attachments) is removed from XAPP’s servers. Users may define retention rules or request immediate purging where available.
All data handling is governed by our Privacy Policy and complies with applicable data protection regulations.

7. Subscription, Billing & Add-ons

- Free Version: No monthly fee. Optional add-ons (e.g., Virtual Number) billed separately.
- Premium / Premium+: Monthly or annual subscription based on plan size and features.
- Payment is processed via secure third-party services (e.g., Stripe).
- Subscriptions auto-renew unless cancelled prior to the billing cycle.
You are responsible for all applicable taxes and fees.

8. Service Availability & Disclaimers

XAPP is provided “as is” and “as available,” without warranties. Riptec Ltd makes no guarantees regarding uptime, delivery, or system compatibility. Riptec Ltd is not liable for service disruptions, data loss, or:
- Lost or delayed messages
- Integration failures with third-party platforms
- Data loss due to misconfiguration or external systems.
Your use of the service is at your own risk.

9. Termination and Suspension

Accounts may be suspended or terminated:
- For violating these Terms
- Upon user request
- If XAPP detects abuse, fraud, or technical risk
Terminated users forfeit all rights to data stored on the platform.

10. Modifications to Terms

We may update these Terms periodically. Continued use of XAPP after changes implies acceptance. Major changes will be communicated via email or system notification.

11. Governing Law

These Terms are governed by the laws of United Kingdom. Disputes arising from these Terms will be resolved under the jurisdiction of courts located in London, United Kingdom.
